finally some good news (for lawyers)

With respect to Chapter 13 cases filed on or after May 1, 2007 Attorneys’ fees of up to $3500 will be allowed without itemization in the Fee Application provided debtor and counsel enter into an amended Model Retention Agreement for representation through the pendency of the case.

If a prior Chapter 13 case filed by the debtor or their spouse was dismissed within a year of commencement of the case in which fees are sought, the Court retains discretion to award less than $3,500. The option of charging a flat fee for services provided only throughthe date of confirmation has been eliminated. If the new Model Retention Agreement is not entered into, or if counsel seeks more than $3500, an itemization will be required.
