Emerald Casino, the debtor in a high-profile Chapter 11 case, sought to transfer its gaming license to a new entity (a move opposed by the Illinois Gaming Board) and have its license restored. The Bankruptcy court dismissed both actions on the part of Emerald, and it appealed to the district court, which affirmed the Bankruptcy court. The Court of Appeals affirmed as well, confirming that the decision was a “police power” properly exercised by the Illinois Attorney General, not a judicial decision.
